Second Amendment Even Applies to Giants

Dave Kopel defends Plaxico Burress against NYC "unconstitutional" gun laws.

  1. A private club (especially one with heavy alcohol consumption) has the right to deny entry to anyone packing a gun (especially someone dumb enough to put one in waistband of SWEATPANTS).

    His defender indicts him pretty well:
    "It appears that he put the unholstered gun in the waistband of his sweatpants, and when it slipped, he grabbed for it, accidentally hitting the trigger. To make matters worse, according to press accounts, he was seen drinking and may have been consuming alcohol -- which all firearms safety training (including the class he would have been required to take for his Florida permit) absolutely forbids for people handling guns. And of course Mr. Burress's handgun should have been holstered to prevent unintentional movement of the trigger. Fortunately, his negligent discharge did not harm anyone else."

    Negligence. Absolutely. Reckless endangerment. Yep. If Burress had operated a vehicle drunk it would be a crime. What if his drunken behavior had accidentally caused the shooting of someone else?

    Carrying in public of a loaded firearm (particularly handgun with the safety off) while intoxicated should carry a mandatory sentence.

  2. New York City's gun laws are indeed draconian and unconstitutional.
    But in order to protect the public we should still outlaw violent NFL homies from owning guns.

    I didn’t see where it said this guy was intoxicated, only that he had been drinking.

    And who carries a rifle into a nightclub?

    And just what is the legal BAC for CUI? (snicker)

    No, once again we see gun-fearing Dave just making it up as he gun-fearing goes…

    Btw, for the childish gun-fearing ignorant folks: Not all handguns have safeties. Some don't need them.

  4. I applaud Bloomberg for the law, and, yes, we do need something in Philadelphia. I believe in the right to bear arms, BUT, that right needs to be documented and verified with a license.

    Plaxico is a moron. He's been a diva/troublemaker in the NFL since he was drafted by Pittsburgh in 2000 out of Michigan State. Now it's 2008, Plax is 31, and this sort of thing happens.

    Here's hoping Bloomberg pushes this case to follow through, not giving Plax any leeway.
