That's bad news for Zimmerman. But it's good news for people who want to find out what actually happened that night in Sanford, Florida.
The prosecution will have to prove that Zimmerman acted with a "depraved" mind. That's what Second Degree Murder requires.
Based on the reported evidence a manslaughter charge - The unjustifiable, inexcusable, and intentional killing of a human being without deliberation, premeditation, and malice - would seem more appropriate. And even that will be difficult to prove in court.
We will see.
There has been enough prejudging and misrepresentation of the facts of this case already. A young man is dead and his killer, who claims he acted in self defense, will stand trial.
May justice prevail.
